The Terms of Use create a binding agreement between the user (you) and Everpath regarding use of the website and our services. By using tryeverpath.com, you also agree to our Privacy Policy. Key provisions include:

Acceptance of Terms

These Terms govern your use of tryeverpath.com and Everpath’s services. When you continue through a page that states that continuing constitutes agreement to these Terms, you agree to be bound by them. If you do not agree, you should not continue using the service.

Services Disclaimer

Everpath facilitates the connection of qualified leads to insurance agents but does not itself sell insurance plans. We do not guarantee eligibility for any particular product, and any quotes are estimates subject to carrier approval. All insurance products are offered by licensed agents and insurers.

Lead Referrals

If you qualify, Everpath or licensed insurance professionals may contact you about applicable insurance options in accordance with the consent you provide through our forms. If you do not qualify for certain insurance options, we may provide your limited contact information to a licensed ACA insurance professional who may contact you regarding alternative coverage, as described in the consent you provided. Everpath may receive compensation if a referral results in enrollment or another qualifying outcome.

Arbitration and Class Waiver

Any dispute arising from these Terms or our services will be resolved by binding arbitration under the AAA Consumer Arbitration Rules, held in your home state (or as required by law). You agree to individually arbitrate all claims and waive any right to a court trial or class action. If you do not wish to arbitrate, you must opt out in writing within 30 days of first using the site (email contact@tryeverpath.com).

Everpath, USHEALTH Advisors, LLC, and their affiliates and agents are third-party beneficiaries of this arbitration provision and may enforce it.

Limitation of Liability

To the maximum extent permitted by law, Everpath’s liability for any claim is limited to the amount you paid, if any, or one hundred dollars. We disclaim all warranties, and all services are provided “as is.”

Governing Law

These Terms are governed by the laws of the State of [Colorado] (or other state), without regard to conflict-of-law principles.

Severability

If any part of the Terms is found unenforceable, the rest remain in effect.
